Balloonatics (Pty) Ltd (“we,” “our,” or “us”) sells novelty kits containing food-grade nitrous oxide (N₂O) and accessories for recreational use by adults aged 18 years or older. These products are not medical devices, and we do not sell or promote illegal or unsafe use of any gas or paraphernalia.

By purchasing from Balloonatics, you agree to be bound by the following terms and conditions. If you do not agree, please do not use this website or purchase our products.

2. Age Restriction

Our products are strictly intended for persons 18 years or older.

We reserve the right to:

  • Refuse sales to minors
  • Require ID verification at the time of sale or delivery
  • Cancel and refund orders if we suspect underage purchasing

3. Legal Compliance

Balloonatics operates in compliance with South African laws governing the sale of food-grade gases and adult novelty products. It is the buyer’s responsibility to:

  • Ensure that use or possession of our products is legal in their jurisdiction
  • Comply with all local, provincial, and national laws

We accept no liability for misuse or unlawful use of our products.

4. Product Use & Safety

Balloonatics products are intended for novelty recreational use only. Misuse of nitrous oxide may cause health risks.
You agree to use our products at your own risk and with full responsibility.

Do not:

  • Inhale directly from the charger or cracker
  • Use more than one charger at a time
  • Operate machinery, drive, or engage in dangerous activities under the influence
  • Use while standing or in unsafe environments

Always:

  • Inflate gas into a balloon before inhaling
  • Use while seated or in a safe, controlled space
  • Read and follow all instructions and warnings

5. Medical Disclaimer

Balloonatics does not provide medical advice. Our products are not intended to diagnose, treat, cure, or prevent any disease. Consult a health professional before use if you have medical concerns.

6. Limitation of Liability

To the maximum extent allowed by law, Balloonatics (Pty) Ltd and its affiliates, suppliers, or agents shall not be liable for any:

  • Direct, indirect, incidental, punitive, or consequential damages
  • Health issues, injuries, or legal actions arising from use or misuse of products
  • Damages due to delay, failed delivery, or loss of product

All products are sold “as is”, with no guarantees except those provided by South African consumer law.

7. Shipping & Delivery

We ship only within South Africa (international coming soon). Orders are processed within 1–3 business days. Shipping time may vary depending on your location.

We are not responsible for:

  • Delays caused by courier services
  • Lost or stolen parcels once marked as “delivered”
  • Incorrect shipping addresses submitted by the buyer

8. Returns & Refunds

Due to the nature of our products, we do not accept returns of used items. However, we will replace or refund any:

  • Defective or damaged items
  • Incorrect items sent

Claims must be made within 7 days of receiving your order. Proof of damage (photo or video) may be required.
